2. service content
Unite is a software service that enables users to exchange and manage primarily digital contact data, but also other information in a secure, efficient and sustainable way. The software consists of a dashboard, an app and a website.
Unite’s dashboard provides a comprehensive solution for managing digital business cards and contact information, including features such as employee management and invitation, a centralized contact database, NFC card ordering, an invoice summary, message board, and customization settings. The dashboard simplifies processes, enables efficient management and sharing of contact information, which can improve an organization’s overall performance. Individual employees, once added via the dashboard, can each create an individual account in the app and actively send and receive Digital Contact information through it. All exchanges between the dashboard and the app are synchronized.
The website is the interface for external users. On the one hand, potential interested parties are forwarded directly to the dashboard, relevant information about the software is visualized and an informative blog is presented.
M&M Enterprise GmbH reserves the right to change the app, dashboard or website at any time in a manner that is reasonable for the user, e.g. in order to develop them further and improve their quality. This applies to both technical and content-related further developments.

3. payment options
Unite offers its customers a 30-day free trial period during which the full functionality of the software can be used. After the trial period expires, the subscription begins automatically and is billed monthly. The price for admin access is 50€ per month (including 3 app accesses), while employee access is charged at 1€ per month. Additionally, NFC cards can be purchased, with the price per card depending on the order quantity.
There is no minimum contract period and the software can be cancelled at any time. After cancellation, the software can still be used in the existing performance period. If payments are not received on time, a first reminder will be sent after 14 days and a second after 30 days. In case of non-payment, access to the software will be blocked.

4. payment processing and right of withdrawal
M&M Enterprise GmbH offers its customers various payment methods, including direct debit, credit card and on account. The customer can choose the payment method that suits him and the payment processing is fast and uncomplicated.
In addition, the customer has a right of withdrawal of 14 days with M&M Enterprise GmbH. Within this period he can withdraw from his contract without giving reasons. To exercise the right of withdrawal, the customer must inform M&M Enterprise GmbH in writing in advance.

5. limitation of liability
M&M Enterprise GmbH takes the utmost care in selecting, maintaining and updating the content. However, M&M Enterprise GmbH assumes no responsibility for the accuracy, timeliness and completeness of the content provided and its selection and compilation. This applies in particular to the extent that M&M Enterprise GmbH is dependent on the supply of texts by third parties.
Insofar as the availability of the software is dependent on the services of third parties (in particular telecommunications providers), M&M Enterprise GmbH assumes no liability.
For damages due to injury to life, body or health, in the case of intent or gross negligence on the part of M&M Enterprise GmbH, a legal representative or vicarious agent, as well as for damages covered by a granted guarantee or warranty, M&M Enterprise GmbH shall be liable in accordance with the statutory provisions.
In the event of slight negligence, M&M Enterprise GmbH shall only be liable for compensation for foreseeable damages typical for this type of contract and only insofar as an obligation, the proper fulfillment of which makes the execution of this contract possible in the first place and on the fulfillment of which the contractual partner could rely (cardinal obligation), has been violated by M&M Enterprise GmbH, a legal representative or vicarious agent. Otherwise, liability is excluded to the extent permitted by law.

6. copyright
The compiled contents of the software are database works specially produced by M&M Enterprise GmbH, specifically databases within the meaning of §§ 4 para. 2, 87a para. 1 UrhG. The associated programs are protected by §§ 69a ff. UrhG.
M&M Enterprise GmbH is the rights holder with regard to all other elements of the app, in particular with regard to the rights of use and ancillary copyrights to content and documents.

7. final provisions
Place of performance and jurisdiction is Vienna. The law of the Republic of Austria shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
Should any of these provisions be or subsequently become invalid, this shall not affect the validity of the provisions as a whole.
